Terms of Use

Last updated: January 2025

1. Service Overview

ContactRx provides medication reminder systems and pharmacy coordination tools for South African community pharmacies. Our platform supports chronic medication adherence programs, repeat dispensing cycles, and structured patient follow-up communication. The service includes SMS reminders, compliance reporting for clinicians, and integration with common pharmacy dispensing software.

2. Registration and Account Responsibilities

Pharmacies register to use the platform and are responsible for maintaining accurate patient consent records and dispensing data. You agree to provide current, complete information during registration and to update it as needed. Account credentials must be kept confidential, and you are responsible for all activity under your account. ContactRx may suspend access if we reasonably suspect unauthorized use or a breach of these terms.

3. Acceptable Use and Patient Consent

You may use the platform only for lawful purposes related to pharmacy operations and patient care. You are responsible for obtaining and documenting patient consent before sending SMS reminders or sharing compliance data with clinicians. You may not use the service to send unsolicited messages, misrepresent adherence data, or process prescriptions outside the scope of your pharmacy license.

4. Service Limitations and Disclaimer

ContactRx provides tools to support adherence tracking and communication, but does not replace professional clinical judgment. We do not guarantee specific patient outcomes, adherence rates, or dispensing results. The platform is provided on an "as is" and "as available" basis. While we aim for reliable SMS delivery and software integration, we do not warrant uninterrupted or error-free operation. Pharmacies remain responsible for verifying prescription details and clinical decisions.

5. Limitation of Liability

To the fullest extent permitted by law, ContactRx shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or harm to patient relationships, arising from your use of the platform. Our total liability for any claim related to the service is limited to the fees you paid in the three months preceding the claim. This section does not limit liability for gross negligence, fraud, or intentional misconduct.

6. Termination

You may stop using the service at any time by contacting our support team. ContactRx may terminate or suspend access if you violate these terms, fail to pay applicable fees, or if continued service would create legal or operational risk. Upon termination, you remain responsible for obligations incurred before the termination date. We will provide reasonable notice where practical.

7. Changes to These Terms

We may update these terms from time to time to reflect changes in the service, legal requirements, or operational practices. When we make material changes, we will notify registered pharmacies through the contact details on file. Continued use of the platform after changes take effect constitutes acceptance of the revised terms.
